These Terms of Use govern your use of the Croft & Commons website. They are separate from any individual client service agreement, proposal, statement of work, design agreement, purchasing agreement, or other contract entered into between Croft & Commons and a client.
Website Use
You may use this website for lawful informational and business purposes. You may not misuse the website, interfere with its operation or security, seek unauthorized access, scrape or automate extraction where prohibited by law, copy or commercially exploit protected Croft & Commons materials without permission, or use website materials in a misleading or unlawful manner.
No Client Relationship or Binding Proposal
Viewing the website, submitting an inquiry, scheduling a consultation, sending information, or communicating through the website does not by itself create a client relationship or binding service agreement. A project becomes subject to Croft & Commons’ service obligations only after the applicable agreement, proposal, scope of work, or other required documentation has been accepted by the appropriate parties. Website descriptions, examples, timelines, availability, pricing references, and other information are informational and may change; they are not a binding quote, estimate, scope of work, or guarantee unless expressly incorporated into an accepted client agreement.
No Guarantee of Financial or STR Performance
Croft & Commons provides design, hospitality, property-preparation, guest-experience, operational, and related services. Nothing on the website guarantees rental income, occupancy, booking volume, nightly rates, reviews, search ranking, investment returns, property appreciation, increased revenue, or business performance. Results vary based on the property, market, location, owner decisions, management, pricing, competition, seasonality, platforms, economic conditions, and other circumstances outside Croft & Commons’ control. Examples, photographs, case studies, concepts, suggestions, and past results are not promises of future results.
Design Concepts, Images, and Representations
Photographs, renderings, mood boards, concepts, layouts, illustrations, examples, and other visual materials may be provided for inspiration, demonstration, portfolio, or conceptual purposes. Final appearance, materials, dimensions, products, availability, construction conditions, colors, costs, installation, and results may differ. Digital screens and photography may reproduce colors differently from physical materials.
Third-Party Products, Vendors, and Contractors
Croft & Commons may recommend or work with third-party products, vendors, tradespeople, contractors, platforms, manufacturers, retailers, service providers, or other independent parties. Unless specifically stated otherwise in a separate written agreement, Croft & Commons does not warrant or guarantee the acts, products, workmanship, availability, policies, timelines, or performance of independent third parties. Responsibilities specifically assumed for a client project are governed by that project’s agreement.
Intellectual Property and Third-Party Links
Unless otherwise indicated, original Croft & Commons written copy, branding, graphics, layouts, concepts, photographs owned by Croft & Commons, downloadable materials, guides, processes, and other original content are owned by or licensed to Croft & Commons and protected by applicable intellectual-property laws. This does not claim ownership of third-party stock photography, fonts, software, trademarks, licensed assets, or materials owned by others. Croft & Commons materials may not be reproduced, distributed, republished, sold, modified, or commercially exploited without permission except as permitted by law. Links to independent sites or services are provided for convenience; Croft & Commons is not responsible for their content, security, privacy practices, availability, products, or services.
Website Disclaimers, Liability, and Indemnification
The website and its informational content are provided on an “as available” basis. Croft & Commons does not guarantee that the website will always be uninterrupted, error-free, complete, or free from technical problems.
